$5,000,000 Cerebral Palsy Birth Injury

Twin pregnancy with the onset of preterm labor during 25th week of pregnancy causing the mother to present at Labor and Delivery where she was found to be 2-3 cm dilated. An emergency c-section was performed. During the c-section, the team struggled to deliver the second twin, who suffered serious injuries during the delivery, resulting in profound brain damage, including the inability to walk or speak. The case settled before trial.

Labor induced at 38 weeks’ gestation was progressing well post-administration of Pitocin drip until the fetal heart rate monitor alarm sounded because the baby’s heart rate dropped critically low.  The Labor & Delivery team responded by having the mother change positions. Our client had a full-term pregnancy. It was determined that she had low-volume amniotic fluid, and fetal distress was observed at the last prenatal visit. This caused the OB/GYN to send the mother to Labor and Delivery. Despite continuing fetal distress (heart rate decelerations), a c-section was not considered. Hours later, Pitocin was ordered to induce labor despite Pitocin being a known cause of fetal distress. Minutes after Pitocin administration, the baby’s fetal heart rate began showing more and worse fetal distress, but an emergency c-section was not performed until almost an hour later. The delay in performing a c-section caused an HIE brain injury, which resulted in permanent, profound brain damage, including the need for 24/7 care by an attendant. The case was settled before trial.

Pregnancy complicated by preeclampsia, which doctor’s office diagnosed but did not immediately hospitalize patient, resulting in critical distress to mother and baby, emergency c-section and extensive NICU stay for the baby, who consistently missed developmental milestones but whose cerebral palsy, due to brain injury at birth, was not diagnosed until several years later. Pregnancy complicated by gestational diabetes caused maternal fetal medicine specialist to advise c-section delivery, but OB/GYN determined an induced vaginal delivery was appropriate. Mother pushed for over 2 hours, followed by OB/GYN attempting vacuum-assisted delivery which failed, and baby ultimately pulled from birth canal by OB/GYN, blue and non-responsive. The baby suffered HIE brain injury during this delayed delivery and suffered permanent brain damage. The case settled before trial.
